Commercial Policy
1.1. The “seller” Clair Couture provides products to sell in its website www.claircouture.com. Its owns services of commerce are available exclusively for the final users / consumers.
1.2. The consumer indicates the individual that acts / buys outside of their business or profession. If you’re not a consumer we ask that you do not carry out a purchase in our website www.claircouture.com
1.3. Clair Couture reserves the right to do not process orders received from user that are not “consumers” or those who are not in according to our general terms and conditions of selling of the seller Clair Couture.
1.4. This terms and conditions regulates exclusively the offers, transmission and acceptance of the orders made in our website www.claircouture.com between the consumers of Clair Couture in our website www.claircouture.com e its seller.
1.5. The “Consumer” must provide the “Seller” an e-mail address, or relative data of other forms of contact, that are corrected and completed and accepts that the “Seller” might contact him using that data, in case that is necessary.
2. How to Order
2.1. Orders
To order in our website www.claircouture.com is necessary that the user owns an e-mail account e that the browser used is configured to accept cookies and pop-ups, allowing the usufruct of all navigability conditions of Clair Couture’s online store.
To make a purchase in www.claircouture.com is an easy process:
1- Find the product(s) you want to purchase;
2- Add them to cart;
3- Finish the purchase;
4- Select the one of payment options;
5- Review your order;
6- Proceed with payment and confirme your order;
7- You will receive an order confirmation by e-mail.
Your order is confirmed when you select the button “Payment Confirmation” (checkout) at the end of the buying process. When Clair Couture receives your order it will appear, on your screen, the order number and all its details. The purchase agreement is finalized in that moment. An order confirmation is send to the e-mail account provided. We suggest that you print it or download it to future reference.
We reserve the right to decline your order, or cancel it even after the automatic order confirmation.
When submitting the order form you are accepting the general conditions of purchase, as well as other existing conditions in www.claircouture.com, through links, including the conditions and general terms of usage.
The Seller may not process orders that do not have sufficient warranty of good collection; when orders are incomplete or incorrect, or when the products ordered are no longer available. In those cases, we will informe you, by e-mail, that the contract of purchase was not done and that the seller did not continued with the sale, specifying the reasons why.
If the products presented in our online store www.claircouture.com are no longer available in the moment of your last access or when the seller receives receives your order, the seller will informe you about the its availability within a 30 days period after the order receipt. If you have made an order an the respective payment for a product(s) that nor longer existes, the seller will proceed to the reversal of the payment for the unavailable itens.
2.2. Rigth of not Acceptance or Canceling the Purchase
Clair Couture reserves the right to refuse any order for any reason. We also reserve the right to cancel any purchase (even the ones you have been already accepted), (among others) in the following situations, exempt from liability for any damage or costs:
The product is no longer available / in stock (the payment will be returned);
The billing information is not correct or is not verifiable;
The order is is signalized by ours Security Systems as an incorrect order or a suspected fraud order;
The transfer for payment of the order is not received by us within a 5 days period after acceptance of the order;
If we think you have less than 16 years old.
If we think your a retailer;
If it is not possible to deliver at the given address.
2.3. Data Verification
After receiving the order we may execute some verifications about it before we prepare it.
These verifications may include the verification of the address, credibility or fraud. About the fraud check we execute partially automated checks in all the orders to filter out unusual transactions, suspicions or identify as susceptible of fraud. Suspicions of fraud will be investigated and, if necessary, sued. By confirming your order you are agreeing with these conditions.
3. Product Warranties and Price Identification
3.1. Payment Methods
You may find all the payment methods accepted when your finalizing your order. We do not accept other forms of payment beyond the presented ones. Please do not intend to pay your order with other means besides the showed ones. If you do so, we can not be responsible for losses or any other damages that may accrue.
3.2. Processing your Payment
If you select the option credit card payment we will deduce the value on your count as soon as your order leaves our storage unit. In this cases, all the details (for example number of card and expiration date) will be send by encrypted protocol by the company that provides the electronic payment at distance services, without access to the transmitted information by a third party.
This informations will not be used by Clair Couture, except to perform the procedures necessary to buy or to repay the payment you have already done, in the cases of reversal of the payment, according to the right of return policy, and to the police, in cases of fraud.
The purchase price of the products and delivery costs, as indicated in the order form, will be charged to the checking account when the ordered products are effectively sent.
4. Order’s Security
4.1. The online store www.claircouture.com uses security technology of the most robust between the encrustation platforms available.
Your payment informations will be encrypted from the moment your in, until your transaction is processed and they won’t be saved in a public server. Although we use encryption software, the security of the information and of payment transmitted by Internet ou over e-mail cannot be ensured.
Clair Couture can not be responsible por any suffered damage as result as use of electronic communication means including, but not limiting to recurring damage from failures or delays in electronic communications delivery, interception or manipulation of electronic communications by third parties or by computer programs used for communication or virus transmission.
Payments can only be processed if the billing information can be verify.
5. Property Reservation
Clair Couture holds the product property the company until receiving the full payment of all those products.
6. Prices
6.1. All prices showed in our site include / bear VAT (value-added tax). Delivery fees are applied per package. The exact price of the shipping fee will depend on the country shipped to. For more informations about the shipping fees see Shipping and Handling on our site.
6.2. The prices are all quoted in euros (€). Please do note that change of country of delivery can influence the prices due to the shipping / delivering costs.
6.3. Total Price
The total price presented in the checkout final menu includes taxes and shipping costs. Price are quoted on order’s confirmation, which you might print or download for further reference. Please pay only the exact value specified on order confirmation e make individual payments per order.
6.4. Price Changes
Product prices presented in this site are not subject to change. Clair Couture reserves the right to alter the prices without previous notice. Prices showed at the moment of purchase are the ones applied to that acquisition.
6.5. Price Errors
Please note that being the site updated regularly with extreme caution it is possible some information presented in the site contains errors. Clair Couture does not compromise with the offer and reserves the right to cancel your order, in the case that error occurs.
7. Quality and Warranty
Clair Couture does not sell second handed products, defective products or with lower quality than the market standards. The main features of each product presented in www.claircouture.com is found in each product page.
Products offered for sale on www.claircouture.com may not correspond exactly to the real garment in terms of picture and colors, due to Internet browser and monitor used.
All our products have an identification tag. Do not remove any tag from the product in case you want to return the product purchased.
In case you want to exceed the right of return of the product purchased, Clair Couture has the right of no acceptance the devolution of the product which are returned without any tag or which other altered in relation to its original design and which were damaged our visibly dressed.
8. Shipping and Delivery
8.1. Delivery
We deliver our products from Monday to Friday, from 9am (9h) to 6pm (18h). We do not deliver in some holidays. We can only fulfill the delivery time if the delivery address is a house or a office placed on one of the countries mentioned on our website.
To receive your order you kneed to make sure someone is in the given address. This service does not include options of scheduling or appointment, so our carrier delivers your package without previous warning. We do not ensure our delivery times in some periods such as promotions, sales, Christmas and stock break.
A delivery is considered done or a product is considered delivered with the signature on the delivery receipt at the agreed address.
8.2. Delivery Times
If you confirm your order in a working day until 0am (12h) and proceed with payment by credit card or Paypal, your order will be shipped on the following working day (weekends and holidays are not considered working days).
Clair Couture will not be responsible for default, or delays in delivering, of any obligation due to force major events, this is, an event, act or omission beyond reasonable control.
We will always try to deliver in the established period, to the extent that it is commercially reasonable. By rule we act always in this way, however, we cannot ensure timely delivery.
8.3. Partial Deliveries
Whenever possible we will try to deliver all purchases in only one dispatch. However, we reserve the right to split the order delivery, for instance (but not limited to) if one part of the order is delayed or no longer available. In case we proceed to the division of the order, the customer will be notified, by e-mail, of our intent to proceed that way. For this purpose it will be used the e-mail supplied by the customer in the moment of purchase.
8.4. Inspection upon Delivery
At the time of delivery, the customer must inspect the packaging for any damage. If you find that the product is damaged, the customer should not accept delivery of the order, which will be returned. Clair Couture will refund the amounts paid for the order and transportation as soon as the warehouse orders and completes the return process.
Any complaint of not receiving an order must be made within a maximum period of 30 days from the date of the order. After this period, Clair Couture cannot be responsible for the loss of the same.
9. Delivery Rates
9.1. Shipping rates are applied by order. The exact price of each shipment depends on the country of delivery. For more details about the shipping price per country, please see the website Shipping & Delivery menu.
9.2. Free Delivery
If the customer places an order whose value exceeds the minimum order value defined for their country or campaign, the shipment will be made free of charge.
10. Returns & Cancellations
10.1. Cancellation of the Order Before Shipment
The customer can cancel the order, as long as it has not yet been sent. If the customer places an order and wants to cancel it, he must contact our Customer Service (talktous@claircouture.com) and request the cancellation of their order immediately. Only after this procedure is it possible for our Customer Service Department to request our warehouse to cancel the order.
If the cancellation request is successful, the customer will be notified by e-mail of this decision and the cancellation will be processed at no cost to the customer. If the cancellation request is not possible the products will be sent to the customer who, if he maintains his intention to cancel the order, should refuse to receive them. Products will be returned and, upon receipt, the chargeback will be processed at the customer's cost.
Custom product orders cannot be canceled before shipping, because the customization process is already in progress, since it starts immediately after receiving the order. However, the customer can make the return according to the conditions and return rules mentioned below.
10.2. Return of Defective Products
The customer has the right to return the products delivered if they are found to have defects or other nonconformities with regard to the products ordered. The return can be made within 30 days of receipt of the order. This does not affect your statutory rights. If your claim is justified, the price and shipping costs will be refunded.
10.3 Return of Products by Withdrawal
If for any reason you are not satisfied with the products you have ordered, you can return them within 30 calendar days after receipt, provided that:
● The products have not been washed or used (unless the product contains information to the contrary, the customer has the right to try on the clothes and shoes to test the size and shape, but can not use them);
● The product retains its original characteristics and the packaging is not damaged (carefully opened containers will not be considered damaged);
● The product is complete (eg both items in a pair have to be returned);
● You can not return:
○ Products that have been tampered with.
10.4. Return of Offers
It is currently not possible for a person who has received a product as an offer from another person to return it. In this case, in order to make a return, you must contact the person who bought it, in the sense that it is returned to you, in accordance with the Return Conditions.
10.5. Product Exchange or Sizes
To exchange one article for another or to change sizes, please follow the steps in Returns.
10.6. Information about the Return
If your return is justified by the existence of a defect or non-conformity with the products ordered, Clair Couture will bear the costs of shipping and return. If your return has been made for reasons other than the justified existence of defect or non-conformity of the products ordered, Clair Couture will not reimburse the costs of shipping. However, when making a return you will be using our transport provider. As the costs incurred by Clair Couture to make the return are equal to the shipping costs, Clair Couture will not reimburse the expenses related to the charges initially borne by the customer to the respective order.
Refunds will be made based on the form of payment.

12. Conditions Applicable to Promotional Codes (Discounts)
12.1. When used according to established rules, a promotion code entitles the user to a promotion / discount for the purchase of a specific product or a set of products, during the period indicated / associated with the promotional code / promotional campaign.
12.2.Promotional codes may only be used for online purchases made on the site. The sale, exchange or donation of a promotional code is not allowed. The customer carrying the promotional code can not upload or make available a promotional code on any website or other public form of offering, donation, sale or exchange. The use of promotional codes for commercial purposes is not allowed.
12.3. The promotion code is connected with the Clair Couture mark. You may not use the promotional code in connection with another brand, company or name. You may not use the promotional code in an illegal, abusive or disrespectful manner, as well as in any other way that could damage Clair Couture 's reputation.
12.4. Use of the promotional code is subject to one use per product and per order only. Promo codes can not be combined with any other promotions or special offers.
12.5. Promotional codes are not exchangeable / exchangeable for cash.
12.6 Clair Couture has no obligation to reissue or refund promotional codes. However, if Clair Couture decides to reissue or refund a promotional code, you need to have access to the initial promotional code. To do this, you need to keep a copy of your promotional code, otherwise it can not be reprinted or replaced in case of loss.
12.7 In cases where Clair Couture reissues / reimburses the promotional code, the discount of this amount may only be applied to a purchase equal to or greater than the purchase in which the discount / promotional code was issued.
12.8 Without prejudice to any other rights, Clair Couture may / has the right to immediately invalidate the promotional code if Clair Couture has reason to suspect that a promotional code is being used: in violation of the above assumptions mentioned, for usurpation or in other cases where Clair Couture has reason to do so.
13. Availability
Satisfaction of all orders placed on the site is subject to availability. Clair Couture tries to ensure that all items offered for sale on the site are in stock. However, Clair Couture reserves the right not to accept any orders or cancel orders already confirmed for products that no longer have stock. In these cases, Clair Couture will inform the customer of this fact and will refund the amount paid.
14. Validity of the Promotion
The offers on the site are valid only for the time they are displayed on the site, unless otherwise communicated on the site. Clair Couture is not bound to any offer, in case of mistakes or mistakes of spelling, prices or others in the information existing in the site. Clair Couture reserves the right to cancel any purchase and sale made under such errors.
15. Liability

15.2 In case the customer has suffered damages related to the activity of the site, the responsibility of Clair Couture will be limited to:
● Damage to Clair Couture products or other materials;
● Reasonable and verifiable costs incurred by the client to find the cause and amount of compensation attributable to the damage;
● The maximum reimbursement of the compensation referred to above will (if applicable) be the price of the products concerned.
15.3 Clair Couture shall not be liable for damages suffered by third parties resulting from the use of any of our products. Clair Couture can not be held liable for damages suffered by the customer as a consequence of improper use of our products.
15.4 Clair Couture shall not be liable for damages resulting from incorrect information on the site.
15.5 In the event that the customer sustains damages resulting from gross negligence or willful misconduct on the part of Clair Couture, none of the limitations set forth in this article apply.
16. Applicable Law
The present general conditions and all emerging litigations that are related to these general conditions, including their validity, the use of the site or any purchase in the same must be governed by the Portuguese Law.
17. Changing Terms & Conditions
Clair Couture has the right to change these Terms & Conditions at any time. The customer is subject to the principles and terms in force at the time of ordering, unless the law or competent authority imposes any change to them.
18. Information on the Site
Although Clair Couture works your site with care, information, text, graphics, movies, music and / or other services may contain errors or be incomplete or incorrect.
Clair Couture shall not be liable for any damages resulting from the use (or inability to use) the site, including damages caused by viruses or any inaccuracy or imperfection of the information, unless such damage is the result of intent or negligence on the part of the Clair Couture.
19. Trademarks and Copyrights of the Site
All brand names, product names and titles used on the site are registered trademarks or registered names of Clair Couture or trademarks and registered names of other owners.
The user / customer of the site is not authorized to use or reproduce any of these trademarks or registered names as this constitutes a violation of the rights of the owners.
Everything concerning the design, texts, documents, movies, music and / or other services of the site, the selection and organization thereof, as well as the entire compilation of software (including applets) and all other materials of the site are property of Clair Couture’s and its suppliers.
Users / customers are only allowed to electronically copy and print portions of the site if necessary to place an order on the site or to use the site as a source for the purchase.
The user / client is not authorized to make any other use of the site or the information and materials contained therein, including reproduction for purposes other than those mentioned above, modification, distribution or republication.
In case the user / client wishes to use information or materials of the site, he / she must obtain prior written authorization and granted by Clair Couture.
